Adult Entertainment Ordinance I. AUTHORITYThis ordinance is adopted pursuant to the general police powers granted under Section 61.34(1), WI. Stats. and specific authority Sec. 236.45, Stats. II. PURPOSEThe purpose of this ordinance is to regulate the placement and operation of facilities within the Village of Browntown to further peace and good order. III. ADOPTION OF ORDINANCE The Village of Browntown has, by adoption of this ordinance, confirmed the specific statutory Authority, powers and duties noted in the specific sections of this ordinance and has established by these sections and this ordinance the certain uses, activities, businesses and operations in the Village of Browntown, Green County, Wisconsin. IV. GENERAL PROVISIONS1. Alcoholic Beverages. No Adult Oriented Entertainment Business shall permit the sale, distribution or consumption of alcoholic beverages on the premises of an Adult Oriented Entertainment Business. 2. No person shall cause, allow or permit the operation of the below noted adult entertainment uses, activities business or operations in the Village of Browntown without a license issued by the Village Board of Browntown trustees: a) Outdoor movie theater b) Adult bookstore c) Adult Motion picture theater d) Cabaret e) Dance hall f) Taverns with a dance hall license g) Massage parlor h) Casino/gambling hall These uses, activities, businesses or operations will be prohibited in all areas in the Village of Browntown within any area circumscribed by a circle which has a radius consisting of the following distances from the outer perimeter of the premises of where these uses, activities, businesses or operations are to occur: a) within one thousand (1000) feet of the outer perimeter of any residential property b) within one thousand (1000) feet of the outer perimeter of any school premises c) within one thousand (1000) feet of the outer perimeter of any church or religious institution premises d) within one thousand (1000) feet of the outer perimeter of any nursing home or day care center premises e) within one thousand (1000) feet of the outer perimeter of a public park or camp ground f) within one thousand (1000) feet of the outer perimeter of any group home premises g) within one thousand (1000) feet of the outer perimeter of any hospital or clinic premises h) within one thousand (1000) feet of the outer perimeter of any residence except the residence of the owner or occupant of the above not4ed use, activity, business or operation i) Within one thousand (1000) feet of the outer perimeter of any other of the above noted uses, activities, businesses or operations No person shall cause, allow or permit the operation of any of the above listed adult entertainment uses, activities, businesses or operations in the Village of Browntown without provisions established for adequate off street vehicle parking for customers. No person shall cause, allow or permit the operation of adult entertainment uses, activities, businesses or operations within the Village of Browntown unless the following provisions have been made: a) No clear glass or transparent tinted glass shall exist within or on the building’s exterior that would allow a casual traveler or shopper to view the uses, activities, business venture or operation which occur therein. b) In the event only part of a building is utilized for adult entertainment purposes, that portion shall be separate from any other parts of the business open to the general public, requiring separation by opaque walls, doors, glass or a combination of any such materials, and a sign in the general public portion shall identify the adult entertainment area. c) Every location subject to this adult entertainment ordinance shall have sign on the building exterior stating the same, either attached to the building or painted or affixed thereon, either upon or immediately adjacent to any doorway allowing public access. d) Without a specific permit issued by the Village Board to the contrary, no adult entertainment center shall admit an individual under the age of eighteen (18) years of age to an area subject to these restrictions. e) No adult entertainment center shall leave exposed to the general public any display, photograph, magazine, film, video or audio tape, recording or other device that is properly within the enclosed, signed area as set forth herein. V. LICENSE No person shall cause, allow or permit the operation of any of the above noted uses, activities, businesses or operations without first being granted a license by the Village of Browntown. Application for such license shall be to the Village of Browntown and must be in writing and include: a) Name, address and phone numbers of individual, partnership, corporation and/or Limited Liability Company responsible for the ownership and/or operation of the premises. b) Complete list of all officers, directors and agents of any partnership, corporation and/or limited Liability Company involved in any way with the ownership and/or operation of the premises. c) The name to be the address and phone number to be used for the premises. The Village Board of Browntown will review the application and may request any further information they feel necessary to consider in the issuance of said license. Licenses shall be good for one year, from July 1 through June 30, and application for renewal must be received and approved by the Village Board of the Village of Browntown prior to the end of the licensing year. Renewal may be denied if any of the provisions of this ordinance are not adhered to, any county, state, or federal regulations are not adhered to, or for any other reason deemed pertinent by the Village Board of the Village of Browntown including but not limited to the effects the adult entertainment establishment has on the community and/or the vicinity surrounding the premises. The yearly fee for the license shall be an amount set by the Village Board for the Village of Browntown and shall be paid to the Village Treasurer prior to the issuance of the license for each year. VI. EFFECTIVE DATEThis ordinance shall take effect and be in force the day after its passage by the Browntown Village Board, and posting by law. Dated this __20____ day of __May_______, 2010. CURFEW ORDINANCE This ordinance is being created regarding setting up curfew requirements in the Village of Browntown. The Village Board of the Village of Browntown do ordain as follows: (1) Purpose. The purpose of this section is to establish curfew hours for minors reduce the incidents of misconduct by juveniles by requiring proper supervision on the part of custodial parents. (2) Definitions. For the purpose of this ordinance, unless otherwise defined: CURFEW HOURS:1. One minute after eleven o’clock (11:01) PM on any day, until five o’clock (5:00) AM the following day, for any person under sixteen (16) years of age.2. One minute after midnight (12:01) AM on any day, until five o’clock (5:00) AM the same day for any person sixteen (16) years of age or older, but less than eighteen (18) years of age. EMERGENCY: Any unforeseen combination of circumstances or the resulting state that calls for immediate action. The term includes, but is not limited to a fire, natural disaster, an automobile accident, or any situation requiring immediate action to prevent serious bodily injury or loss of life. ESTABLISHMENT: Any privately owned place of business operated for a profit to which the public is invited, including but not limited to, any place of amusement or entertainment. GUARDIAN: A person who, under court order, is the guardian of the person of a minor; or a public or private agency with whom the minor has been placed by a court. MINOR: Any person under eighteen (18) years of age. PARENT: A person who is a natural parent, adoptive parent or stepparent of another person; or a person at least eighteen (18) years of age and specifically authorized at a time by a parent or guardian to have care and control of a minor. PUBLIC PLACE: Any place to which the public or a substantial group of the public has access and includes, but is not limited to, streets, highways, sidewalks, public parking lots, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities and businesses. REMAINS: To linger or stray; or fail to leave premises when requested to do so by a police officer or the operator or person in control of the premises. SERIOUS BODILY INJURY: Bodily injury that creates substantial risk of death or that causes death, serious permanent disfigurement, or protracted loss of impairment of the function of any bodily member or organ. 3) Offenses:1) A “minor” as defined commits an offense if the minor remains in any public place or on the premises of any establishment within the City during curfew hours. 2) A parent or guardian of a minor commits an offense if the parent or guardian knowingly permits, or by insufficient control allows, the minor to remain in any public place or on the premises of any establishment within the City during curfew hours. 4) Defenses:1) It is a defense to prosecution under subsection (3) of this Ordinance if the minor was:a. Accompanied by the minor’s parent or guardian;b. On an errand specifically authorized by the minor’s parent or guardian, without any detour or stop;c. In a motor vehicle involved in interstate travel, without any detour or stop;d. Engaged in an employment activity, or going to or returning home from an employment activity, without any detour or stop;e. Involved in an emergency;f. On the sidewalk abutting the minor’s residence or abutting the resident of a next-door neighbor if the neighbor did not complain to the police department about the minor’s presence;g. Attending an official school, religious, or other recreational activity supervised by adults and sponsored by the city, school, civic organization, or another similar entity that takes responsibility for the minor, or going to or returning home from, without any detour or stop, an official school, religious, or other recreational activity supervised by adults and sponsored by the city, school, civic organization, or another similar entity that takes responsibility for the minor. 5) Enforcement: Before taking any enforcement action under this section, a police office shall ask the suspected offender’s age and reason for being in the public place or on the premises. The officer shall not issue a citation or make an arrest under this section unless the officer reasonably believes that an offense has occurred and that, based on any response and other circumstances, no defense in subsection (4) of this section is present. This ordinance shall take effect and be in full force from and after it’s passage and posting. 6) Penalty:Any person who violates any provision of this section shall be subject to a penalty of a minimum of $100 and a maximum of not more that $1,000. RESOLUTION No. 2009-09-15 Resolution Authorizing Additional Duties for Clerk/Treasurer STATE OF WISCONSIN Village of Browntown Green County The Village Board of Trustees for the Village of Browntown, Green County, Wisconsin, by this resolution, adopted by a majority of the Village Board Trustees on a roll call vote with a quorum present and voting and proper notice having been given, resolves and orders as follows: The Village Clerk/Treasurer shall perform, under lawful direction of the Village Board, the following duties in addition to those specifically enumerated in s.61.25 (1) to (10) and s. 61.26 (1) to (11), Wis. Stats.: 1) To by order of Village President sign payroll checks 2) To by order of Village President sign checks for emergency repairs for the Street Department, Water Department and Sewer Department The Village Clerk/Treasurer shall properly post or publish this resolution as required under s. 61.25 (4), Wis. Stats. Adopted this 15th day of September, 2009. RESOLUTION No. 2009-7-21 Well Water Protection Whereas, the Village of Browntown has is responsible for protecting the safety of the well water supply in the Village and, Whereas, it is illegal to have a cross connection to the drinking water system, and Whereas, the Public Service Commission gives the Village the authority to insure the safety of the well water supply, and Now, Therefore Be It Resolved, that the Village of Browntown Trustees have passed a resolution to have every resident install an exterior backflow eliminator on all outside water hydrants and remove any internal cross connections. Penalty for a cross connection shall be water disconnection and the cost attributed to disinfecting the system. Water service will be resumed when the cross connection has been eliminated. Adopted, at a regular meeting of the Browntown Village Board this 17th day of March 2009. VILLAGE OF BROWNTOWN ORDINANCE FILTH, RUBBISH, AND UNWHOLESOME SUBSTANCES This ordinance amends the previously issued Filth, Rubbish, and Unwholesome Substances Ordinance #15 dated April 2, 1951. WHEREAS, the Trustees of the Village of Browntown intend to promote the public health, and safety of the citizens of the Village of Browntown, and BE IT THEREFORE RESOLVED, that the Trustees of the Village of Browntown, do ordain as follows: Section 1 –Throwing Unwholesome Substances and Dirt, etc., Upon Public Grounds, No person or persons shall place or leave any slop, dirt, water or other liquid of offensive smell or otherwise nauseous and unwholesome, or any dead carcass, carrion, meat, fish, entrails, manure, pet waste or other nauseous or unwholesome substance or matter, or any dirt, filth, straw or other rubbish, or any ashes, garbage, dirt, or refuse of any kind or description, in or upon any street, gutter, sidewalk, alley or public ground in this village; and, Section 2 –Premises to be Kept Free From Rubbish and Filth, It shall be the duty of every owner, occupant, agent or person in charge of any premises, improved or vacant, within this village, that shall abut upon any sidewalk, to keep the same free from rubbish, dirt, and filth of any kind; and, Section 3 – All Premises to be Free of Filth, etc., Any person or persons, firm or corporation who maintain on any premises owned or occupied by him, or who suffers or permits to exist on such premises any accumulation of rubbish, filth or material of any kind that is likely to become a breeding place for flies, or is liable to become a place for the development of fly larvae, or any source of filth or cause of sickness or any stagnant or foul water shall be fined; and, ENFORECMENT AND PENALTIES The Browntown Village Board of Trustees is authorized to enforce the provisions of this ordinance, and the penalty for violations of any portion of this ordinance shall be determined by resolution passed by the Board of Trustees. EFFECTIVE DATE This ordinance shall take effect after its passage and posting according to Law.
